Resolution # 78

Approval of Minutes

Motion: Councilor Palerino         Second: Councilor Ryan

Resolve that the Town Board approve the minutes of the March 09, 2010 Board Meeting as submitted by the Town Clerk.

All in favor:      Ayes 7             Nays – 0          Carried

Public Hearing- Time Warner Cable Franchise Renewal Agreement for television service in the Town of Geddes.

The Supervisor on motion from Councilor Czaplicki, seconded by Councilor Ryan and duly adopted opened the Public Hearing at 7:09PM.

No one from Time Warner was present to speak.

Pamela Goldstein of McGuire Woods LLP, representing Verizon New York Inc. spoke about deficiencies in the Time Warner proposal she felt would reduce the benefits to the Town of Geddes. She gave a printed copy of her presentation which will be added to the Time Warner file in the Town Clerk’s office.

Nick Mazza, of 113 Bury Drive also spoke about the services and questioned the quality of the products offered.

Supervisor Falcone stated that no decision would be made tonight. With no one else wishing to be heard the Supervisor, on motion from Councilor Czaplicki, seconded by Councilor Ryan and duly adopted closed the public hearing at 7:24PM.

Petitions:

Derek Tarolli – 3 Dwight Park Drive – Application to Build

Mr Derek Tarolli appeared before the board to seek approval of a Site Plan application for a 4,000 square foot building at 3 Dwight Park Drive.

Resolution # 79

Referral – Site Plan review

The Supervisor on motion from Councilor Palerino, seconded by Councilor Czaplicki and duly adopted referred the proposal to the Geddes Planning Board for their further review and recommendation.

Public Comments

Ron Bildstein, 66 Hardwicke Dr spoke at length about his difficulty is selling his house. He felt that the house was assessed improperly. He was going to talk to the Town of Geddes, Village of Solvay and Solvay School District to seek advice and correction. He gave a printed copy of his presentation which will be held in the Town Clerk’s office. Greg Low, 62 Hardwicke Dr added his comments regarding the assessed values within the Town. Hank DeStefano, 207 Wilshire Rd mentioned the STAR program as a possible remedy.

Edward Haines, 320 Bergner Rd expressed his concern and disappointment over the condition of his property due to people parking on his lawn while shopping at local stores. The issue of no curbing on the Byrne Dairy side of the road and problems with mud runoff was also addressed. The Highway committee will address this at their next committee meeting.

Resolution # 80

The Town Board authorizes the following budget modifications to the 2010 Budget.

BUDGET ADMENDMENT:

EXPLANATION:

A police vehicle was involved in an accident in which the other driver was at fault. The budget is being amended to reflect the receipt of the insurance check and is an allowable exception to the rules on when a budget can be amended.

EXPLANATION:

The pump for the boiler system was rebuilt in order for the system to work and created an over-budget condition. This transfer provides funding to pay the voucher.

Resolution # 81

PERMA Conference / Comptroller Greg Maxwell

Authorization for the Comptroller to attend the PERMA (Workmen’s Compensation) business conference on May 26 – 27, 2010. There is no cost to the Town except for mileage.

Resolution # 82

Agreement for Maintenance with Verizon Wireless / 202 Chapman Drive

Authorization for the Town Supervisor to sign the “agreement for maintenance” with Verizon Wireless for the property at 202 Chapman Drive, Geddes, NY, subject to the zoning approvals being granted by the Town ZBA.

Resolution # 83

Public Hearing Scheduled – SPDES Permit – Stormwater Discharges

Schedule a public hearing for the May 11, 2010 Town Board Meeting to review the SPDES General Permit for Stormwater Discharges from Small Municipal Separate Storm Sewers (MS4) Annual Report.

Public Hearing Scheduled – Tim Hortons – Subdivision

Authorization for the Town Board to schedule a public hearing for the May 11, 2010 Town Board Meeting to consider the subdivision plans for Tim Hortons.

Highway Superintendents School – Highway Superintendent

Authorization for the Highway Superintendent to attend the Annual Spring NYS Highway Superintendents School from June 7 to June 9 at Ithaca College. The cost is $90.00 be taken from the Travel account.

Highway, Sewer & Drainage Construction, Maintenance for Brantford Park Section 2

Approving the Highway, Sewer & Drainage Construction and Maintenance agreement with John C Smolen, for Brantford Park, Section 2 subdivision and authorizing the Supervisor to execute the Agreement on behalf of the Town.

Resolution # 88

New Position Duty Statement

Motion: Councilor Ryan                                Second: Councilor Patalino

Authorize Comptroller to prepare a new position duty statement and submission to Onondaga County Department of Personnel (Civil Service) for Court Attendant.

After much discussion, Councilor Ryan moved to rescind his motion. Councilor Patalino moved to rescind his second.  The Supervisor stated that he would address the motion in the future.

Farrell Road Construction Project – C & S Engineers

Authorize C & S Engineers to perform a subsurface investigation, core drilling, onsite representation and a letter report of pavement evaluation and recommendations for Farrell Road construction project, not to exceed $8,000.00.

Farrell Road Construction Project – C & S Engineers

Authorize C & S Engineers to do base mapping and surveying from John Glenn Blvd to Rte 48 for Farrell Road construction project design purposes, not to exceed $20,700.00.

Table the Proposed Resolution Authorizing the Supervisor to sign the renewal agreement for Maintenance, Repair and Energizing the Highway Lighting I – 690 Interchange with NYS Department of Transportation.

Declare Police Radios as Surplus Equipment

Authorization for the Police Department to declare 16 portable police radios and 10 mobile police radios as surplus equipment. The 30 yr old radios are no longer needed by the Police Dept.

Resolution # 93

Donate Police Radios to National Ski Patrol

Authorization  to donate 6 surplus portable radios to the National Ski Patrol, a not for profit organization, for their ski patrol use.

Deduct Rental Fees from Outstanding Bills

Authorization to direct the Comptroller to debit from any issues or bills from the Village of Solvay the fees that are owed to the Town of Geddes as specified in the budget .

Executive Session

On motion of Councilor Patalino and seconded by Councilor Ryan, the following resolution that the Board move into executive session to discuss personnel issues was unanimously adopted. 8:27PM

The executive session ended at 8:43PM. The supervisor stated that no action was taken.

Grievance Denial

Highway Union filed a grievance, which was denied by the Board.
