An informational report was given by Lucille Fox, Town of Geddes Assessor, regarding an exemption from Real Property Taxes for Cold War Veterans. A Cold War Veteran is a person, male or female, who served on active duty in the United States Armed Forces during the period from 9/2/1945 to 12/26/1991 and was discharged or released under honorable conditions.



Public HearingA Local Law Amending Chapter 215 of the Geddes Code with Regard to Abandoned and Junked Autos



WHEREAS, pursuant to the provisions of the Municipal Home Rule Law, a proposed local law entitled Local Law No. F of 2009, “A Local Law Amending Chapter 215 of the Geddes Code with regard to Abandoned and Junked Autos” in the Town of Geddes, was presented and introduced at a regular meeting of the Town Board of the Town of Geddes held on December 8, 2009. The Local Law in its entirety is on file in the office of the Town Clerk.


The public hearing was opened at 6:25 PM.


Code Enforcement Officer Peter Albrigo stated that this law would update Town Law to coincide with State Law enacted in 2007. It would amend the language of chapter 215 of State Law.

Mike Kempisty of 1187 State Fair Blvd spoke out against the local law. He disagreed with the definitions in the law and the appeals process.

With no one else wishing to be heard, the Supervisor, on motion from Councilor Palerino and seconded by Councilor Patalino, and duly adopted closed the public hearing at 6:37pm.

Public Hearing – A Local Law Amending the Zoning Map of the Town of Geddes to Change the Zoning Designation for Certain Property from being Zoned Residential A: Single Family Residential District to Commercial B. Said property is located at the corner of Smelkoff Road and State Fair Blvd and is more detailed and described in the attached Schedule A. A complete copy of the Local Law and related items are on file and available for review in the Town Clerk’s office at the Town Hall during regular business hours.

The Supervisor on motion from Councilor Ryan and seconded by Councilor Czaplicki and duly adopted opened the public hearing at 6:40pm.

Nick Mazza of 113 Bury Dr questioned what might happen to the building and property if it changed owners. He supported the VFW project, but was concerned about future plans.

Councilor Palerino stated that it was his understanding that if the property changed hands and this project was not completed that any new owners of the property would go through the same process as the VFW Hall.

Howard Bain, Commander of Post 2893 spoke about the project and reiterated that the position of the Post was to build a VFW Hall in the 5,000 – 6,000 sq ft size range. The Post has an informal commitment from Solvay Bank for $200,000 and already had over $20,000 collected for the building project.

Steve Bagozzi, chairman of the building committee also spoke and said that the property would be used for a VFW Hall only. It would be open 6 times a month. The reason for the change to Commercial was that the VFW Building did not fit in Residential A zoning.  He also stated the building was tied in to the National VFW organization and any changes in use would need to be approved by them.

Councilor Ryan spoke to the point that the Zoning and Planning committee suggested changing to Commercial B so the building would fit in a conforming use. He also mentioned the Pope Project and Smolen Development as positive developments to the area.


With no one else wishing to heard the Supervisor, on motion from Councilor Patalino and seconded by Councilor Ryan, closed the public hearing at 7:08PM.

Supervisor Falcone introduced Councilor Valenti as the newest member of the Town Board. Councilor Valenti stated he resided in Westvale with his wife and 2 children. He thanked the board for appointing him and said he looked forward to serving the people of the Town of Geddes.


Public Comments

Cara Burton, Solvay Library Director spoke about the Onondaga Lake Bottom Remediation Program. She is a member of the Citizens Participation Group. There is a public information meeting at the NYS Fairgrounds on Thursday January 14 at 500PM.  They will give an update

on the progress. She has been appointed Village of Solvay Historian. She spoke about

requesting assistance for the Library through State and Federal officials. The Library is also

seeking donations for their future.


Resolution # 31

Authorization for the Town Board to make budget modifications to the 2009 budget.

The Town Board authorizes the following budget modifications to the 2009 budget.


EXPLANATION:

Postage costs for the mailing of accounts payable checks, payroll checks, W-2, and correspondence has exceeded budget. These costs are allocated from the centralized postage machine and have been increasing yearly due to postage rate increases.


EXPLANATION:

Rugs are rented from Aramark for use at the garage in the break room and office areas. The cost of this service has increased over $600 from 2008 and required additional funding.


EXPLANATION:

Parks and recreation uses cell phones during the summer for communicating to the various locations for safety reasons. Due to a change on the Town is charged for these phones during the six-week summer program, the cost exceeded the budget.

EXPLANATION:

The Police have requested additional funding for radio maintenance and car repairs. Included in the car repairs are snow tires for the winter season and routine maintenance for the fleet as it ages.


EXPLANATION:

Legal costs for works performed for the planning board have exceeded budget and need additional funding.


EXPLANATION:

Total costs, including construction and engineering, for the expanded 2009 highway-repaving program was budgeted into the repaving account. Each month, a transfer is made to the engineering expense line where the costs are recorded.

introduced proposed Local Law No. A-2010 Amending Chapter 200 of the Code of the Town of Geddes to Provide for a Real Property Tax Exemption for Cold War Veterans in Accordance with New York State Real Property Tax Law § 458-b which was seconded by .

WHEREAS, New York State Real Property Tax Law allows local municipalities to adopt and permit certain real property tax exemptions for Cold War Veterans, and the Town Board of the Town of Geddes desires to enact a local law in this regard; and

WHEREAS, no other agency has the legal authority or jurisdiction to approve or directly undertake the enactment of a local law in the Town of Geddes, such that there are no other involved agencies within the meaning of the New York State Environmental Quality Review Act (SEQR) with respect to the proposed enactment of said Local Law, with the result that the Town Board shall act as lead agency in this matter.

NOW, THEREFORE, it is

RESOLVED AND DETERMINED, that the enactment of proposed Local Law No. A of 2010 is a Type II action and therefore will have no significant effect on the environment, thus concluding environmental review under SEQR; and it is further

RESOLVED, that the Town Board shall conduct a public hearing as to the enactment of proposed Local Law A-2010 at the Town of Geddes Town Hall, 1000 Woods Road, in the Town of Geddes, on February 9, at 7:00 p.m., or as soon thereafter as the matter can be heard, at which time all persons interested on the subject shall be heard.

BE IT ENACTED by the Town Board of the Town of Geddes as follows:


Section 1.


Section 215-4 of Chapter 215 of the Code of the Town of Geddes is deleted in its entirety and replaced with the following:


§ 215-4.   Notice of violation.

If the provisions of the foregoing section are violated, the Chief of Police, Police Officer or Code Enforcement Officer shall serve written notice, either personally or by certified mail, upon the owner of the motor vehicle or boat or on the owner, occupant, lessee or tenant of such public or private property to comply with the provisions of this chapter.  The notice shall be in substantially the following form:


TO THE OWNER OF THE MOTOR VEHICLE OR BOAT OR THE OWNER, OCCUPANT, LESSEE OR TENANT OF THE PROPERTY WITHIN THE TOWN OF GEDDES KNOW AS:

NOTICE IS HEREBY GIVEN that an abandoned, junked or discarded motor vehicle or boat has been stored or deposited on the above-described property in the Town of Geddes in violation of a local Geddes ordinance, copy attached.  Violation of this chapter constitutes an offense.  The automobile or boat must be removed within ten (10) days from the date of this notice.  Failure to remove in accordance with this notice may subject you to a fine not to exceed $250 and/or imprisonment for up to fifteen (15) days.  Each ten (10) day period from the date this notice is served shall constitute a separate and distinct offense. Please advise the Issuing Officer, Telephone No.____________________ of your compliance with this notice.

Section 2.

Section 215-5 of Chapter 215 of the Code of the Town of Geddes is deleted and replaced with the following:


§ 215.5.  Penalties for offenses.


An owner of a motor vehicle or boat or any owner, occupant, lessee or tenant who shall neglect or refuse to remove an abandoned, junked or discarded motor vehicle or boat, as directed by this chapter, shall, upon conviction thereof, be fined a sum not exceeding $250 for each violation thereof or be imprisoned for a period not to exceed fifteen (15) days, or be both fined and imprisoned.  Each separate occurrence and each ten (10) days a vehicle or boat remains unmoved after notice has been served in accordance with this chapter shall constitute a separate and additional violation.  A violation of this chapter shall be an offense.”

Section 3. Effective Date.


This Local Law shall take effect upon its filing with the New York Secretary of State.

The following resolution was offered by Councilor Palerino, who moved its adoption, seconded by Councilor Ryan, to wit:

WHEREAS, pursuant to the provisions of the Municipal Home Rule Law, a proposed local law titled Local Law No. G-2009, “A Local Law Amending the Zoning Map of the Town of Geddes to Change the Zoning Designation of Certain Property from being zoned Residential A:  Single Family Residential District to being zoned Commercial B” was presented and introduced at a regular meeting of the Town Board of the Town of Geddes held on December 8, 2009; and

WHEREAS, a public hearing was held on such proposed local law on the 12th day of January, 2010 by the Town Board of the Town of Geddes and proof of publication of notice of such public hearing, as required by law, having been submitted and filed, and all persons desiring to be heard in connection with said proposed local law having been heard, and said proposed local law having been in the possession of the members of the Town Board of the Town of Geddes in its final form in the manner required by Section 20 of the Municipal Home Rule of the State of New York; and

WHEREAS, at its December 8, 2009 meeting this Board determined that the enactment of Proposed Local Law No. G-2009 is an unlisted action that there are no other involved agencies, that this Board will act as lead agency for this action; and

NOW, THEREFORE, it is

RESOLVED AND DETERMINED, having reviewed the short Environmental Assessment Form, and after considering all potential environmental impacts and comparing the action with the criteria set forth in 6 N.Y.C.R.R. Part 617, this Board, as lead agency, makes the following findings:

The parcels to be rezoned are presently surrounded by lands zoned residential and commercial;

The parcels to be rezoned have traditionally been utilized for residential purposes;

No negative environmental impact will be realized by surrounding properties as a result of the requested zone change;

No negative impact on the character of the community or neighborhood will be realized as a result of the requested zone change;

No negative impact on existing air quality, groundwater quality or quantity, noise levels, traffic patterns, solid waste production or disposal will be realized nor will the potential for erosion, drainage or flooding increase;

Any further approvals will require additional review and SEQR consideration by the Town;

The requested zone change for use as a Veterans Hall is consistent with the Town’s existing plans or goals and will not negatively impact the intensity of use of land;

RESOLVED AND DETERMINED, that this Board determines that there will be no adverse environmental impacts emanating from the proposed action and therefore renders a negative declaration with respect thereto for purposes of SEQR;

RESOLVED AND DETERMINED, that the Town Board of the Town of Geddes, Onondaga County, New York, does hereby enact Proposed Local Law No. G-2009 as Local Law No. 2-2010 as follows:

A Local Law Amending the Zoning Map of the Town of Geddes to

Change the Zoning Designation for Certain Property from being Zoned

Residential A: Single Family Residential District to Commercial B



BE IT ENACTED by the Town Board of the Town of Geddes as follows:


Section 1.      The Zoning Map of the Town of Geddes, as provided for in Section 240-10 of the Code of the Town of Geddes and filed with the Town Clerk, shall be amended to change the zoning use designation of certain lands described in schedule “A” from Residential A to Commercial B as such Zoning Districts are described in the Code of the Town of Geddes.


(See Schedule A attached hereto).


Section 2. The parcel of land which shall be the subject of said zone change totals approximately 1.55+/- acres is designated by tax map number 024.-07-04.2 and is located at the corner of Smellkoff Road and State Fair Blvd.


Section 3. The Town of Geddes Zoning Map shall be amended and shall incorporate the change of zoning classification as herein provided.


Section 4. This Local Law shall become effective upon filing with the New York Secretary of State.



SCHEDULE A

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Geddes, County of Onondaga and State of New York, being known as part of Lots 23 and 24 of said Town, bounded and described as follows: BEGINNING at a point marking the intersection of the center line of the Van Vleck Road and the Southerly line of premises conveyed to William H. Ullman and Florence W. Ullman by deed dated October 10, 1911 and recorded in the Onondaga County Clerk’s Office October 17, 1911, in Book 394 of Deeds at page 360&c., thence westerly along the southerly line  of the said Ullman property a distance of 334.5 feet; thence northerly at right angles to the said Ullman southerly line a distance of 113.9 feet; thence easterly at right angles to the last mentioned line and parallel with the said Ullman’s south line a distance of 119.2 feet; thence easterly on a line at right angles with the Van Vleck Road 158.0 feet to the said center line; thence southerly along the center line of the Van Vleck Road a distance of 67.14 feet to an angle in the centerline; thence southerly along the center of the Van Vleck Road a distance of 82.0 feet to the place of beginning.


Being the same premises conveyed to Pasquale Canestrare and Iris Canestrare by deed dated December 4, 1975 and recorded in the Onondaga County Clerk’s Office December 4, 1975 in Book 2569 of Deeds at Page 805.  Said Pasquale Canestrare having died on the 25th day of August, 2003 leaving said Iris Canestrare surviving tenant by the entirety.


Subject to easements, covenants, and restrictions of record, if any.
